After our summer abroad, we are launched into the fall and full swing in the network. I have had repeated requests to hold our webinar series again to educate about private lending and best practices, so I am sending out this message to see if you are interested.

In the world of real estate investing, securing the right funding is crucial—but it’s equally important to protect yourself from scams and bait-and-switch tactics.

Red Flags to Watch Out For:

Pressure to Act Quickly:
Scammers may push you to make hasty decisions. A trustworthy lender will give you the time you need to make informed choices.

Lack of Transparency:
If a lender hesitates to provide full information about fees, terms, or loan conditions, consider it a red flag.

No Physical Address or Contact Information:
A legitimate lender will have verifiable contact information. Be wary of lenders who are only reachable via anonymous channels.

High Upfront Fees or Wire Transfer Requests:
Requests for large fees upfront, especially via wire transfer, are common scam tactics. Pay only standard application fees if absolutely necessary.

Complicated or Confusing Loan Terms:
Watch out for overly complex terms that seem designed to confuse. Simplicity and clarity are signs of a trustworthy lender.

No Proof of Funds:
A credible lender should provide proof of funds or financial statements. If they can’t, move on.

Changing Terms Last Minute (Bait and Switch):
Be vigilant if a lender changes the terms at the last minute. This is a classic bait-and-switch move.

Promises of Guaranteed Approvals:
Legitimate lenders will perform due diligence. Be skeptical of anyone offering guaranteed approval with no questions asked.

Unprofessional Communication:
Poorly written emails, unprofessional conduct, or inconsistent messaging are often indicators of a scam.

Top Tips for Avoiding Scams in Real Estate Funding:

Verify Lender Credentials:
Always confirm the lender’s licensing and credentials through state regulatory bodies or trusted associations like the National Mortgage Licensing System (NMLS).

Research Reviews and Reputation:
Check reviews on trusted platforms such as Better Business Bureau (BBB), Trustpilot, or even within our own network. Real feedback from other investors can be invaluable.

Get Everything in Writing:
Document all promises and agreements in writing. Never rely on verbal commitments alone.

Use Escrow Services:
To secure transactions, use third-party escrow services. This ensures funds are only released when terms are met.

Avoid Upfront Fees:
Be cautious of lenders asking for significant upfront payments. Reputable lenders may charge small fees, but large pre-service fees are a major red flag.

Be Wary of “Too Good to Be True” Offers:
If the terms seem too favorable, proceed with caution. These offers can often be bait-and-switch tactics.

ARV is one of the most use terms in REI. It's so important that it's one of my first questions when discussing a new project. Why are we so strict on the ARV? Because, regardless of your exit strategy, at some point an appraisal will be required after renovations and before the property is sold (or refinanced). This means that if we do not follow the appraisers method for valuation we could be off significantly and lose big on a project. Knowing the ARV for any project is crucial for success.

Ps. Here are some key rules and considerations for Americans purchasing property in France:

1. Legal Restrictions: There are no significant legal restrictions on Americans buying property in France. Both residents and non-residents can purchase property without needing special permits.

2. Property Types: Buyers can purchase various types of properties, including residential, commercial, and land. However, agricultural land might have more regulations.

3. Process Overview: Initial Agreement (Compromis de Vente): Once a property is selected, the buyer and seller sign a preliminary contract called "compromis de vente." This contract outlines the terms of the sale and is usually accompanied by a deposit of around 10% of the purchase price.

4. Cooling-Off Period: After signing the initial agreement, buyers have a 10-day cooling-off period during which they can withdraw from the sale without penalty.

5. Final Contract (Acte de Vente): The final contract is signed in the presence of a notary (notaire) who ensures that the transaction is legally sound. The notary also handles the payment of taxes and registration of the property.

6. Notary Fees and Taxes: Buyers need to account for notary fees and property taxes. Notary fees typically range from 6-8% of the property price for older properties and around 2-3% for new builds. Additional taxes and fees may include stamp duty and registration fees.

7. Financing:Mortgages: Americans can obtain mortgages from French banks, though the process might be more complex for non-residents. It's advisable to have a significant down payment, usually around 20-30%. Currency Exchange: Consider fluctuations in exchange rates and the cost of transferring money internationally.

8. Ongoing Costs: Property ownership in France comes with ongoing costs such as property taxes (taxe foncière and taxe d'habitation), maintenance, and insurance.

9. Residency Considerations: Owning property in France does not grant residency rights. If planning to live in France for an extended period, Americans will need to apply for the appropriate visa or residency permit.

10. Legal and Tax Advice: It's crucial to seek legal and tax advice from professionals familiar with French property law and international transactions. This helps ensure compliance with all regulations and optimization of tax liabilities.

11. Inheritance Laws: French inheritance laws are different from those in the U.S. and include "forced heirship" rules, which may affect how property can be passed on to heirs. Legal advice is essential to navigate these laws.

12. Additional Regulations: Certain regions might have additional regulations, especially in protected or historical areas. Always check local regulations before purchasing.

Great TIPS that JD posted on recognizing Scams in Private Money Lending!

⚠️OUR TIPS LIST for avoiding Scams and Bait & Switch techniques in Private Money Lending for Real estate!⚠️

Unfortunately, Stacy and I have consistently run into honest people who were scammed or tricked into bait & switch plans by devious people in the private money lending sphere. We compiled a list for you while in Paris to recognize the "Red Flags" that you need to look out for. Here they are:

TIPS TO RECOGNIZE SCAMS AND BAIT-AND-SWITCH TACTICS IN PRIVATE MONEY LENDING🚨

1. Research the Lender Thoroughly:

Check the lender’s credentials, reviews, and ratings. Look for any red flags or negative feedback from previous clients. Ask friends, other REIs/PMLs or family if they have heard of the lender or heard anything.

2. Beware of Upfront Fees:

Legitimate lenders usually deduct fees from the loan proceeds rather than requiring large upfront payments. Be cautious if a lender demands substantial fees before processing your loan.

3. Check their Public and Social Media Presence:

Are they verified on FB, LinkedIn, Alignable etc. Do they have any presence both personal and/or business wise on legitimate platforms? Major Red Flag if they have no presence and say that they are too busy, not technical, or too "old school" to have a presence (anyone that is that busy, is usually making a ton of money and can have any intern, family member or assistant create a presence for them...Just take a look at any legitimate business person- ALL of them have a presence, even if they are not technical and paid someone to do it.

4. Understand the Terms Clearly:

Read all the terms and conditions carefully. Ensure that the interest rates, repayment schedule, and fees are transparent and well-documented.

5. Check for Proper Licensing:

Verify that the lender (if a "Hard Lender") is licensed to operate in your state or country. Unlicensed lenders are often a red flag for potential scams.

6. Watch Out for Too-Good-to-Be-True Offers:

Be skeptical of offers that promise extremely high returns with little to no risk (without explaining in detail about Risk Mitigation practices) Scammers often use unrealistic promises to lure investors.

7. Get Everything in Writing:

Insist on having all agreements and promises in writing. Verbal agreements are difficult to enforce and can lead to misunderstandings or fraud.

8. Verify Contact Information:

Check the lender’s contact information, including their physical address and phone number. Avoid lenders who only provide a P.O. box or generic email address (Gmail non-business email)

9. Consult with a Legal Professional:

Have a real estate attorney or REI/PML expert review all documents before you sign. An attorney can help you identify any hidden clauses or potential issues.

10. Ask for References:

Request references from previous clients and contact them to inquire about their experience. Legitimate lenders should have no problem providing references.

11. Be Cautious of High-Pressure Tactics:

Scammers often use high-pressure tactics to rush you into making a decision. Take your time to evaluate the offer and do not feel pressured to act immediately.

12. Use Trusted Platforms:

Engage with lenders through reputable platforms that have verified and vetted their members. Trusted platforms offer an additional layer of security and credibility.

13. Trust Your Instincts:

If something feels off or too good to be true, trust your instincts and proceed with caution. It’s better to miss an opportunity than to fall victim to a scam.

Always be cautious and skeptical...This is your hard earned money, so, never have a fear of missing out while doing your due diligence and you will avoid most scams!
