How Did Florida's 2023 Tort Reform Affect Personal Injury Cases?

⚖️ Florida's 2023 tort reform changed several important rules that affect personal injury claims.

If you've been injured in an accident, these changes could impact your legal rights.

📌 Some of the biggest changes include:
✅ The statute of limitations for most negligence claims was reduced from 4 years to 2 years.
✅ Florida changed from pure comparative negligence to modified comparative negligence, meaning you generally cannot recover compensation if you are found to be more than 50% at fault.
✅ Changes were made to certain medical billing and Letters of Protection.
✅ Bad faith insurance claims became more difficult to pursue.

These legal changes have made personal injury cases more complex than before, making it even more important to understand your rights and act quickly after an accident.

⏳ Waiting too long could affect both the evidence available and the time you have to file a claim.

💬 Were you aware that Florida reduced the deadline to file most personal injury lawsuits from four years to two years? Let us know in the comments.

🚖 Can you sue Uber or Lyft after a rideshare accident in Palm Beach County?

The answer depends on what the rideshare driver was doing at the time of the crash—and who was at fault.

Here's how it generally works:

• If the Uber or Lyft driver was actively transporting a passenger and caused the accident, you may have a claim involving the driver and available insurance coverage.

• If another driver caused the accident, your claim would typically be against the at-fault driver—not Uber or Lyft.

• If the rideshare driver was offline and caused the crash, the claim is generally handled through the driver's personal auto insurance.

Rideshare accident claims can be complicated, and Uber and Lyft have legal teams focused on protecting their interests.

Knowing which insurance policy applies can make all the difference.

We had a great time at our first Park Vista High School Parents Open House! 🎓🚗

Joy, Noah and I had the opportunity to connect with local families and talk about something we’re passionate about: keeping drivers—especially young drivers—safe on the road.

We brought actual dash cam footage from one of our client’s crashes and even had a live video feed from our dash cam so parents could see exactly how it works.

And we didn’t just talk about safety—we put it into action! 🙌

We held a drawing and three lucky attendees went home with a dash cam to help protect themselves and their families on the road.

Thank you to everyone who stopped by, asked questions, and helped make the event such a great one. We’re proud to be part of the Palm Beach County community and to continue spreading the message that being prepared behind the wheel matters.

What If I Was Partially At Fault For The Accident In Florida?

⚖️ In Florida, being partially at fault for an accident does NOT automatically mean you lose your case.

Under Florida’s modified comparative negligence law, you may still recover compensation as long as you are not more than 50% at fault.

📌 Example:
If your damages are $100,000 and you are found 20% at fault, you may still recover $80,000.

But here’s the problem 👇

Insurance companies will often try to shift more blame onto you to reduce — or completely deny — your payout.

🚗 That’s why evidence matters. Dash cam footage can be one of the strongest tools in a case because it can help show:
✅ What actually happened
✅ Vehicle speeds
✅ Road conditions
✅ Driver behavior before impact

The sooner you preserve evidence, the stronger your position may be.

💬 Do you think dash cams should be standard in every vehicle? Let us know in the comments.

Who is at fault when a crash leads to a violent road rage assault? 👇🚗

Dashcam footage captures a collision, where a driver cutting through stopped traffic collided with an oncoming car, leading to a violent altercation.

As an Injury Lawyer, a road collision never justifies physical violence. Cutting across active lanes without clear visibility violates right-of-way rules, creating clear liability for the resulting vehicle damage. Assaulting another driver after an impact creates severe criminal and civil consequences. Clear video evidence protects victims by documenting both the traffic fault and the physical assault for court. Always stay inside your vehicle and contact law enforcement immediately after a crash. ⚖️

Can I Still File A Claim If I Didnt Call The Police After My Accident?

🚔 Didn’t call the police after your accident?

You may still be able to file a claim — but proving your case can become much more difficult without an official police report.

That’s why details matter.

📌 If there was no police report, important evidence can include:
✅ The other driver’s information
✅ License plate details
✅ Dash cam footage
✅ Photos and videos from the scene
✅ Witness statements

⚖️ Without a report, it often becomes your word against theirs. The faster you act, the better chance you have of preserving valuable evidence before it disappears.

The DashCam Lawyer has successfully handled many accident cases without police reports over the past 21+ years.
