Case Study: A licensed professional counselor (LPC) providing services through a mental health app faced a state board investigation related to conduct, boundaries, and documentation. The outcome included disciplinary action that affected her license, finances, and professional record.

This case underscores how boundary crossings, casual communication, and assumptions about how an app handles disclosures and documentation can lead to serious regulatory consequences. For counselors, especially in telebehavioral health, understanding ethical requirements, maintaining professional boundaries, and keeping clear, accurate records are critical parts of safe practice.

Myth: A patient can only allege malpractice during the course of treatment. Once I’m no longer seeing them, I can’t be named in a lawsuit.

Malpractice claims may be brought months or even years after treatment ends, and may be made by a patient, or by a parent, guardian, family member, or an estate. As a result, care you provided in the past can still be the subject of a future claim.

Keeping an occurrence-based individual professional liability policy current and active throughout your career can help support you if a lawsuit arises, subject to the policy’s terms, conditions, and exclusions. This type of policy is designed to cover incidents that happen during the policy period, even if a claim is brought at a later date.

Understanding how malpractice coverage works is an important part of helping to protect your career. Learn more about common myths and truths about professional liability insurance: https://brnw.ch/21x2HGX

Myth: I’m a student and I’m covered by my institution. I don’t need a policy of my own.

Students are still gaining experience, but they can be named in a malpractice claim. While institutional coverage may offer some protection, it may not apply in every situation or fully address individual exposure.

HPSO - Healthcare Providers Service Organization offers professional liability coverage designed for students, with options that can continue as you transition into practice. Understanding how coverage works early on can be an important part of preparing for your career. Learn more: https://brnw.ch/21x2sCc

Myth: Malpractice insurance is cost prohibitive. I’d rather take my chances than have to spend so much money up front.

As a healthcare provider, you may be exposed to the risk of a malpractice incident or lawsuit simply by the nature of your work. The average lawsuit can exceed six figures, which can affect the career and financial stability you have worked hard to build. To help make coverage more affordable, convenient installment payment plans are available, customers can choose to pay for their policies in 3 or 10-payments.

HPSO - Healthcare Providers Service Organization offers coverage for healthcare professionals to help protect your career and help safeguard your future. https://brnw.ch/21x2okN
