Two simple rules for handling a minor accident (on a street, in a parking lot, anywhere)

1. If it’s their fault call the police immediately and get their insurance information BEFORE they come.

Nowadays police departments issue citations and accident reports with much of the personal information, including the insurance company and policy number redacted (blacked out).

If a person says they will pay you themselves rather than go through the insurance company THEY ARE LYING.

2. take a picture of their car with license plate, and the damage to both cars. You will need this for proof either in court or with the insurance adjusters.

Everybody is out for themselves when it comes to paying or being at-fault. It is the sad reality. Don’t make the mistake of being the nice guy.

When you have a damage pipe or sump pump you may find that while the insurance carrier covers the water damage they will not cover the pipe or the sump pump itself. It doesn't seem to make sense, Why?

Here's an important insurance phrase regarding this coverage exclusion.
"Latent defect, inherent vice or any quality in property that causes it to damage or destroy itself"

latent defect is a defect in the system you cannot see or diagnose like a crack or weak spot.
Inherent vice is the basic nature of pipes and pumps, they may rust, corrode, or be constricted over time.

In short, the insurance company is not in the business of insuring defective or old pipes and machinery. That is a maintenance issue.

So, if a defective pipe or pump causes water damage it is probable that the carrier will cover that damage but require the homeowner to pay for the damaged pipe or pump. I've seen it before. They insurance carrier paid for the water damage but not the plumber's invoice to fix the burst pipe. Make sense now?

NUCLEAR VERDICTS: GOOD FOR LAW FIRMS. BAD FOR BUSINESS.

According to a new report from strategic communications and research firm Marathon Strategies, there were nearly 200 verdicts resulting in an award of at least $10 million in 2025. Verdicts like this against corporate defendants have come to be known as "nuclear verdicts," and the total from 2025—a 40.7% increase over 2024—is the highest Marathon has seen since 2009.

“While many factors have influenced this growth, Marathon’s research identified corporate mistrust, social pessimism, erosion of tort reform, and public desensitization to large numbers as among the most important,” Marathon said in the 42-page report, adding that more Millennials and Gen Z people are showing up juries. The firm said Millennials have proved to be pro-plaintiff, prioritize ethics, and are less trusting of companies.

Suing big companies is in vogue (some deserve it), creating funds to bet on cases is common, and getting that big payday is the dream of many. However, what is John Q. Public getting? He's getting higher insurance rates and higher prices because when companies can't affort to insure they take their business elsewhere or cease altogether, leaving you with fewer choices and higher prices.
