Terms of Service and Agreement
The following is the user management agreement hosted by the one-stop service platform PEC:
PEC Service Agreement：
Introduction: The full name of the PEC platform is "Partner E-commerce". PEC has a team of more than 800 professionals, providing comprehensive e-commerce solutions and expertise in various fields such as technology, operations, marketing, warehousing, logistics and customer service. The company aims to provide a complete e-commerce planning and operation map for world-class brands, and create real commercial value for the brand.
The PEC platform integrates the functions of an international well-known brand dropshipping, self-built online shopping mall, advertising agency placement, logistics docking, order docking, customer service agency processing, and other shopping mall comprehensive agent operation platforms. By integrating these capabilities, PEC provides a one-stop solution for brands looking to build or enhance their e-commerce presence. PEC's comprehensive e-commerce services, combined with its advanced technology and experienced team, make it an excellent choice for businesses looking for reliable and effective e-commerce solutions in China
Purpose of Agreement: This Agreement is entered into between [you] (“Customer”) and PEC (“Service Provider”) for the purpose of establishing the terms and conditions under which PEC will provide Store Management Services to Customer. Scope of services: PEC will provide customers with the following customer store management services: SONY, CASIO, LEGO, DYSON, BMW, BOSS HUGO and more than 60 international famous brands are authorized to deliver goods through the platform.
Product Hosting: PEC will host the brand's products on its platform for sale to a broad customer base.
Payment Processing: PEC will handle all payment processing, including the management of refunds and returns, and payment-related customer service inquiries.
Shipping Management: The PEC will manage the shipping of customer products, including tracking and customer service inquiries.。
TERM OF AGREEMENT: This Agreement shall commence at [Activation of Service] and shall continue until terminated by either party upon written notice at [Expiration of Service].
Fees: Clients will pay the following fees for PEC's client store management services: [service fees within the platform].
Confidentiality: The parties will keep all confidential information obtained from the other party confidential and will not use such information for any purpose other than the performance of this agreement.
Intellectual property rights: All intellectual property rights of the hotel management service and platform are owned by PEC. Customer has no right to use or reproduce the Platform or any part thereof without the express written consent of PEC.
Responsibility statement: PEC will undertake the following responsibilities to partners who cooperate with PEC. Shipping costs for customer returns will be borne by PEC. In the process of product transportation, if the product is damaged due to accident or other reasons, the cost of product loss will be borne by the insurance company submitted by PEC to ensure that the partner's funds will not be lost. Lost profits are not included.
Compensation: If you have any disputes or disputes in the process of cooperating with PEC, you can email us through the lawyer team. If you spread rumors and slander PEC's reputation without communication, you will receive a notice of prosecution from our law firm, and you will bear all legal responsibilities and compensations arising therefrom.
Termination: Either party may terminate this Agreement by written notice to the other party if either party materially breaches this Agreement.
Dispute Resolution: Any dispute arising out of this Agreement shall be resolved by arbitration in accordance with the rules of the British Arbitration Institute.
Applicable Law: This Agreement is governed by the laws of [Wales, United Kingdom].
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings and negotiations between the parties.
Amendment: This Agreement may only be amended by a written document signed by both parties
By executing this agreement, the customer agrees to be bound by the above terms and conditions.
Operating Package Terms and Indemnity Agreement:
1. If you purchased and opened a store operation package on the PEC platform and did not generate any income or losses due to missing sales orders, you can get compensation.
2. To qualify for compensation, you must fully comply with the terms and conditions of the PEC platform, including but not limited to complying with product release rules, completing orders on time, providing accurate product information, and responding to customer inquiries in a timely manner.
3. If you meet the conditions, the PEC platform will unconditionally compensate you for the store operation package fee.
4. The compensation amount is equal to the amount paid for the store operation package.
5. After receiving the compensation request, the PEC platform will make compensation within 30 days.
6. The PEC platform reserves the right to pay compensation after investigating and verifying the owner's claim.
7. This compensation policy is subject to change without prior notice, and the revised policy will take effect immediately after being published on the PEC platform website.
8. This compensation policy applies to the laws of the place where the PEC platform is registered. Any dispute arising from this policy will be resolved through arbitration in accordance with the rules of the relevant arbitration institution.
Insurance Regulations:
If the user encounters logistics problems during the cooperation with the company:
For example: tsunami, piracy, transport ship failure, aircraft failure, product leakage encountered in shipping is designated as polluting or dangerous goods, resulting in product damage, loss, (commodity leakage is designated as polluting or dangerous goods) being abandoned halfway.
This will directly lead to the loss of items and the interruption of the transaction. If the transaction cannot be completed, you can only apply for insurance compensation. PEC will apply for insurance compensation for you, and will reply to the approval result within 30 days after submission.
We will calculate the total cost of goods lost at that time to apply for compensation.
If you pay 5% insurance premium for the total price of the goods, then you will apply for 3 times the total price as compensation. The compensation funds will be completed within 180 days after the insurance company approves, and the insurance company will transfer the compensation amount to the PEC company. The insurance payout funds will be allocated by the PEC company.
If you do not pay the 5% insurance premium, you will only be able to apply for the cost of goods and the loss of logistics costs.
Distribution of insurance compensation funds:
Please note: If the user succeeds in applying for insurance compensation, PEC will deduct your logistics fee % and operating service fee %. We will issue the full amount of funds paid by the insurance company to the user, and the financial department will not deduct any funds from the amount.
You need to pay us the logistics fee and operation service fee separately.
Partner agreement:
After joining, register an account - open a store - open operation services - (recharge funds) process shopping orders for customers - after the transaction is completed - cooperative brand commission settlement - system settlement profit.
In order to support our partners, we have distributed a certain amount of funds to subsidize users who open stores.
If you do not generate transaction volume, you will not be able to withdraw the store opening commission and store opening allowance separately.
Volume needs to be generated, otherwise it will violate the partner agreement. False users will not enjoy commission subsidies and store opening subsidies.
