Do you aware and fully understand insurance nomination?

What will happen:
- If you have nominee who is incompetent to contract
- If you have aged old parents
- If your loved ones do not know how to manage wealth

Who is incompetent to contract ?
- Where a person has not attained the age of eighteen years
- Where a person who is certified by a medical practitioner fully registered under the Medical Act 1971 [Act 50] to be of unsound mind

Where does the payment go to if the person who is incompetent to contract ?
- to the parent of the incompetent nominee other than the policy owner and where there is no surviving parent
- if the policy moneys exceed fifty thousand ringgit, shall pay the policy moneys to the Public Trustee or a trust company nominated by the policy owner

Headace for incompetent to contract (Minor) :
- Will the appointed trustee (person) hold the proceeds (policy moneys) for the child before 18 or use all the policy moneys for himself/herself?
- What if appointed trustee (person) passes away, will all the policy moneys fall under the estate of that person (trustee)?
- I want my child to be the sole beneficiary of the insurance proceeds but how?
- Is my child able to manage the lump sum of policy moneys if he/she is just above 18 years but below 25 years?
- What if my nominee is in coma or physically/mentally incapacity?

Do you know that when divorcee passes away, in usual case, the ex-spouse, being the biological parent of the child, will be the legal guardian?

If there was a Will properly written, the divorcee can appoint someone he or she trusts to be the joint-guardian with the ex-spouse.

There are also many other ways to prevent the ex-spouse from tapping into the assets if proper estate planning is done.

If there is no difference for a person dies with Will or without Will, all estate shall be frozen. So, what is the big deal to have Will made before untoward event?

What is a Will?

A Will is a declaration intended to have legal effect of the intentions of the person (testator) with respect to his property or other matters which he desires to be carried into effect after his death, until which time it is revocable.

Is it true that by writing Will, all estate shall not be frozen?
- No.
- Whether with or without Will all estate shall be frozen pending to the application of Probate or letter of administration.
