What is a Company Voluntary Arrangement (CVA)?

A CVA is a process which is a useful tool when a company has a prospect of continuing in some form in order to repay its creditors either in full or in part. To do this a proposal is put to the creditors. It needs to be a viable option for both the creditors and the company. Creditors must agree to the proposal.

This is one of various options available to a company and it is imperative to speak to an insolvency practitioner as they will advise you of the best option to take to understand all the options available.

What is a Creditor’s Voluntary Liquidation (CVL)?

A CVL (usually simply known as a liquidation) is a process whereby the business comes to an end and its assets are liquidated to pay creditors if possible. This process is initiated by the company directors and shareholders – hence the word voluntary, although of course, directors do this because they have to not because they want to.

Once a director is aware that their company is facing financial issues they should take professional advice from an insolvency practitioner.

A CVL is one of many insolvency processes; however, there are other processes that may be more appropriate and an insolvency practitioner can advise on the alternatives.

Why should you seek advice from an insolvency practitioner for your personal financial situation?

Asking a friend or family member who may have gone through a similar financial situation may seem like a good idea for advice at first; however, they are not experienced, qualified or regulated.

What may seem like good advice could put you in a worse place if followed. Everyone is different and what is right for one, is not necessarily right for another.

Therefore, it is important to seek advice from an insolvency practitioner who knows what to do in any financial circumstance. They will also be able to help you through the full process.

Please give us a call on 020 8688 2100 or 01323 723643 for further information.

Why should you seek advice from an insolvency practitioner for your business?

Do you know a business that is struggling financially? The worst thing a director can do is try to tackle the situation on their own with no advice. Doing this could be detrimental to the business and expose the director to personal risk.

Directors generally do not have experience in insolvency and restructuring and therefore could fall foul of many things.

Seeking advice from an insolvency practitioner as early as possible will mean that the company will have more options open to it.

Please give us a call on 020 8688 2100 or 01323 723643 for confidential advice.

What is an Individual Voluntary Arrangement (IVA)?

An IVA is an arrangement with an individual’s creditors to repay some or all of their debt over a period of time. The creditors must agree to the proposal. The proposal will usually offer a better return to the creditors than they would receive in a bankruptcy.

For an individual it should be a better alternative than a bankruptcy and can be a very useful process especially when someone owns their own home.

To discuss all the options available it is essential to speak to an insolvency practitioner for advice as soon as possible.
