🚨 Important Update for MSBs: FINTRAC Address Requirements

Attention Money Services Businesses (MSBs),

A recent update from FINTRAC may impact how MSBs submit their business address information.

Based on recent communications, FINTRAC is no longer accepting shared office spaces as a standalone business address for MSB registrations and updates.

➑️ MSBs may now be required to provide a copy of a lease agreement demonstrating legitimate access to the premises listed in their application.

This requirement is expected to apply to:
β€’ New MSB registrations
β€’ Renewals
β€’ Change requests
β€’ Any currently pending applications

At this time, a formal public notice may not yet be widely published, but the requirement is reportedly already being applied in the application review process.

⚠️ MSBs using shared office addresses should review their registration details carefully, as missing documentation could lead to processing delays.

The change may be part of broader efforts to address concerns around shell MSBs operating from shared office locations or nominee structures.

More details will likely emerge as FINTRAC clarifies the scope of this update.

Create based on that πŸ‡¨πŸ‡¦ FATF 2025–2026 Review: Where Canada Stands

Canada has now completed the on-site phase of its 2025 Mutual Evaluation by the Financial Action Task Force (FATF).

πŸ“Œ Official results have not yet been published.
The full report β€” including ratings on both technical compliance and effectiveness β€” is expected in 2026 following FATF plenary deliberations.

What this means:

FATF evaluations no longer focus only on whether laws exist.
They assess whether the system produces measurable AML/ATF outcomes.

Key areas under scrutiny include:

β€’ Beneficial ownership transparency
β€’ Suspicious transaction reporting quality
β€’ Enforcement results and prosecutions
β€’ Sanctions implementation
β€’ Risk-based supervision

For Canadian reporting entities β€” including MSBs, crypto platforms, banks, and capital markets firms β€” this review signals:

➑ Higher expectation of demonstrable effectiveness
➑ Increased supervisory intensity from FINTRAC
➑ Potential policy acceleration and legislative refinement
➑ Greater correspondent banking scrutiny if deficiencies are noted

Even without grey-list implications, perception alone can impact cross-border risk assessments.

The shift is clear:

Compliance programs must prove results β€” not just policies.

For MSBs in particular, proportional regulation and regulatory coherence will remain critical as reform momentum continues.

The 2026 report will likely shape Canada’s AML/ATF framework for years to come.
